Cavallari seeks primary custody in divorce with Cutler

Marital problems can enter the life of any marriage. Whether spouses are newlyweds or married for decades, the decision to end a marriage could occur at any point. And with this decision comes with it many more difficult and important decisions to make. Although divorce is difficult for any spouses initiating the process, being in the public eye further complicates the matter.

The news that Kristin Cavallari and Jay Cutler are divorcing has come as a shock to many, but what has been reported following the announcement of their decision to end their marriage is equally as surprising.

What happened?

To begin, there are some discrepancies on who initiated the divorce. It was reported that the former quarterback for the Bears filed for divorce on April 21, listing their date of separation as the same. However, Cavallari filed paperwork on April 24 and listed their date of separation as April 7, which was the same day the couple returned from the Bahamas after being stuck there for three weeks.

It was further reported that Cavallari cited inappropriate marital conduct as well as irreconcilable differences as grounds for divorce. She further claimed that his inappropriate conduct renders cohabitation unsafe and improper. She went on to assert that Cutler has not been the available at-home parent and primary caretaker of their three kids like he has asserted.

In light of these claims, Cavallari has requested primary custody of their three children, ages 7, 5 and 4. Furthermore, she is requesting child support and for Cutler to pay for health insurance and health-related expenses. In contrast, Cutler is seeking joint custody of there three children. There are currently no reports on how the two seek to handle other divorce issues beyond their family law matters.

Divorce can be a very complex matter, especially when children are involved. The focus should be on the best interests of the children, and when there are many working parts in a divorce, it is imperative that all these claims are properly assessed. Because these matters are emotional, they can be challenging to navigate. Thus, it is helpful to have legal guidance in family law matters.
